Hong Kong Trade Mark Registration: Process, Fees And Cross-Border Protection Strategy
Hong Kong trade marks are examined by the Trade Marks Registry of the Intellectual Property Department, with transparent official fees and a clear process. Huanchen follows every stage from pre-filing search to the opposition period, and helps plan combined protection across Hong Kong, mainland China and overseas.
WHO IT SUITS
Who should register a Hong Kong trade mark
Products or services launching in the Hong Kong market that need a local registration against counterfeiting and squatting.
Sellers operating through a Hong Kong company who want a trade mark to support platform brand registry and enforcement.
Businesses using Hong Kong as a first step before filing under the Madrid System or in individual countries.
Companies that have found an identical or similar mark filed in Hong Kong and need to assess opposition or re-filing options.
Three things to know before filing
Better preparation means a lower chance of objections during examination and publication.
- Authority: the Trade Marks Registry of the Intellectual Property Department; applications are filed on Form T2, online filing available
- Nice Classification: 45 classes in total, classes 1–34 for goods and 35–45 for services; class selection defines the scope of protection — too narrow leaves gaps, too broad wastes fees
- Pre-filing search: checking the Registry for identical or similar earlier marks is the single most important step before applying
- Distinctiveness: purely descriptive marks, generic names or signs indicating only quality are generally not registrable
- Applicant eligibility: individuals and companies of any nationality or residence may apply
Official fees and overall timeline
Official fees are public and modest, and a smooth application typically takes about 6–9 months.
- Official filing fee: HK$2,000 for the first class, plus HK$1,000 for each additional class
- Overall timeline: about 6–9 months from the filing date to the registration certificate if no objections or oppositions arise
- Term of protection: 10 years from the filing date, renewable indefinitely in 10-year periods
- Possible extra stages: responding to examiner objections or oppositions; Huanchen explains the handling approach and fee boundaries upfront
PROCESS
Five steps from search to certificate
- 01
Search and assessment
Earlier marks are searched, the likelihood of registration assessed, and classes and filing strategy fixed.
- 02
Filing
Form T2 is filed with the Trade Marks Registry, securing the filing date and application number.
- 03
Formal and substantive examination
The Registry checks formalities first, then examines distinctiveness and conflicts with earlier marks; Huanchen prepares responses to any examiner objections.
- 04
Publication and opposition
Accepted applications are published in the Gazette for a 3-month opposition period; with no opposition, or an unsuccessful one, the mark proceeds to registration.
- 05
Registration
The certificate of registration is issued. Protection runs for 10 years from the filing date, with renewal arranged before expiry.
Hong Kong, the mainland and overseas: three separate systems
Trade mark protection is territorial. A Hong Kong registration is valid in Hong Kong only, so multi-market businesses need a combined filing plan.
- A Hong Kong registered mark is protected only within the Hong Kong SAR and does not extend to mainland China or any overseas market
- To protect a brand in mainland China, a separate application must be filed with the CNIPA; examination standards and earlier rights in the two jurisdictions are independent
- A Madrid Protocol international application can designate many member countries in one filing, but Hong Kong cannot be designated under the Madrid System
- Huanchen sequences filings across Hong Kong, the mainland and target overseas markets, including priority claim strategy, according to your rollout plan
Why Huanchen
Filing looks simple; responding to objections and oppositions is where professional value lies.
- Search and success assessment come first — we do not file blindly
- Class advice reflects actual business and defensive needs, avoiding protection gaps
- Examiner objections and oppositions are handled by dedicated staff, with no response deadline missed
- Renewal reminders and monitoring keep the mark under control after registration
- Integrated with Hong Kong incorporation and annual review services, keeping brand ownership aligned with the operating entity
No firm can guarantee registration — objections and oppositions are always possible. Huanchen manages the risk down to a controlled level through pre-filing searches and professional responses.
FAQ
Frequently asked questions
Can an individual apply for a Hong Kong trade mark?
Yes. Individuals and companies of any nationality or residence may apply. If the brand is operated by a company, filing in the company’s name avoids later ownership and licensing complications.
Can one application cover multiple classes?
Yes. Multi-class applications are accepted: HK$2,000 for the first class and HK$1,000 for each additional class. Classes should cover current business and foreseeable extensions.
If I am registered in Hong Kong, do I still need a mainland filing?
Yes. Hong Kong registration protects the mark in Hong Kong only. If you plan to sell, open online stores or exhibit in the mainland, file with the CNIPA early — earlier rights in the two jurisdictions do not affect each other.
What happens if my mark is opposed during publication?
Anyone may oppose within the 3-month period. A counter-statement must be filed within the deadline, or the application may be treated as withdrawn. Huanchen assesses the grounds of opposition and prepares the response.
Can a registered mark be revoked for non-use?
Yes. A mark that has not been genuinely used in Hong Kong for a continuous period of 3 years may be revoked on application by any person. Keep evidence of use such as invoices, packaging and marketing records.
