PROCESS

    Publication and opposition

    Accepted applications are published in the Gazette for a 3-month opposition period; with no opposition, or an unsuccessful one, the mark proceeds to registration.

    The certificate of registration is issued. Protection runs for 10 years from the filing date, with renewal arranged before expiry.

TERRITORY

Hong Kong, the mainland and overseas: three separate systems

Trade mark protection is territorial. A Hong Kong registration is valid in Hong Kong only, so multi-market businesses need a combined filing plan.

  • A Hong Kong registered mark is protected only within the Hong Kong SAR and does not extend to mainland China or any overseas market
  • To protect a brand in mainland China, a separate application must be filed with the CNIPA; examination standards and earlier rights in the two jurisdictions are independent
  • A Madrid Protocol international application can designate many member countries in one filing, but Hong Kong cannot be designated under the Madrid System

Can an individual apply for a Hong Kong trade mark?

Yes. Individuals and companies of any nationality or residence may apply. If the brand is operated by a company, filing in the company’s name avoids later ownership and licensing complications.

Can one application cover multiple classes?

Yes. Multi-class applications are accepted: HK$2,000 for the first class and HK$1,000 for each additional class. Classes should cover current business and foreseeable extensions.

If I am registered in Hong Kong, do I still need a mainland filing?

Yes. Hong Kong registration protects the mark in Hong Kong only. If you plan to sell, open online stores or exhibit in the mainland, file with the CNIPA early — earlier rights in the two jurisdictions do not affect each other.

What happens if my mark is opposed during publication?
